1. Who We Are & What These Terms Cover
These terms govern all bookings and enquiries made with Proven Adventures (“we”, “us”), a tour operator based at Jahazi Building, James Gichuru Road, Lavington, Nairobi, Kenya. They apply to packages, tailor-made itineraries, accommodation-only bookings, MICE and corporate travel services booked through this website, by email, phone or WhatsApp. Making a booking means the lead traveller accepts these terms on behalf of the whole party.
2. Bookings & Confirmation
A booking is confirmed only when we issue a written confirmation and receive the stated deposit — typically 30% of the trip price, or full payment for departures within 30 days. Until confirmation, all quotes are subject to availability and price changes by lodges, airlines and park authorities. The lead traveller must be at least 18 and is responsible for the accuracy of all names, dates and passport details supplied.
3. Prices, Currency & Payment
Prices are quoted per person sharing unless stated otherwise, in Kenya Shillings (KES) or US Dollars (USD) as shown on your quote. Currency conversions displayed on the website are indicative; your confirmation states the binding amount and currency. Rates for citizens, residents and non-residents differ where parks and hotels apply tiered pricing, and you must book under the tier you qualify for — mis-declared residency may result in surcharges collected at the gate or check-in. Balance payment is due 30 days before departure. We accept bank transfer, M-PESA and major cards; card payments may carry a processing fee disclosed before you pay.
4. Children & Child Rates
Child rates apply to the age band shown on each package (commonly 2–11 years, sharing with adults). Ages are taken at the date of travel and may require proof at check-in. Infants below the child band are usually free but must still be declared for park entry, flights and lodge policies. Some camps set minimum ages for game drives — we flag these at booking.
5. Changes & Cancellations by You
Tell us early — options shrink close to departure. Cancellations are subject to the following standard scale unless your confirmation states supplier-specific terms: more than 60 days before departure, loss of deposit; 59–30 days, 50% of the trip price; 29–15 days, 75%; 14 days or fewer, or no-show, 100%. Date and name changes are treated as amendments where suppliers allow (an amendment fee may apply); otherwise they are cancellations. Unused services after departure are not refundable.
6. Changes & Cancellations by Us
Occasionally we must alter an itinerary — for example when a lodge overbooks, a road becomes impassable or a flight schedule changes. Where changes are significant we offer a comparable alternative or a refund of the affected portion. If we cancel a confirmed trip for reasons other than force majeure or your non-payment, you receive a full refund of amounts paid to us. We are not liable for costs booked independently of us, such as international flights.
7. Travel Documents, Visas & Health
Travellers are responsible for valid passports (six months beyond return), visas or eTAs, and vaccinations required for their itinerary — including yellow fever certificates where applicable. We advise on requirements in good faith, but final responsibility rests with each traveller. Denied boarding or entry for missing documentation is treated as a cancellation by you.
8. Travel Insurance
Comprehensive travel insurance covering medical treatment, emergency evacuation, cancellation and personal effects is mandatory on all safaris and strongly recommended on every other trip. Medical facilities in remote areas are limited, and evacuation costs are significant without cover.
9. Health, Safety & Wildlife
Safaris take place in wild environments. Travellers must follow the instructions of guides, drivers and lodge staff at all times, particularly regarding wildlife, walking at night and swimming. We reserve the right to remove from a trip, without refund, anyone whose behaviour endangers themselves, other guests, staff or wildlife.
10. Our Liability
We select lodges, transport providers and activity operators with care and act as agent for these suppliers. We are liable for the proper performance of our own services, but not for events beyond our reasonable control — including weather, wildlife behaviour, political events, strikes and third-party service failures. Nothing in these terms excludes liability that cannot be excluded under Kenyan law. Any claim must be notified to us in writing within 30 days of the trip ending.
11. Complaints
If something is wrong during your trip, tell your guide or our 24/7 support line immediately so we can fix it on the spot — most issues are resolved within hours. If a matter remains unresolved, write to hello@provenadventures.com within 30 days of returning and we will respond within 14 working days.
12. Governing Law
These terms are governed by the laws of Kenya, and the courts of Kenya have exclusive jurisdiction over any dispute arising from them.
